GUARANTEE

The Certainty Group Full Value Guarantee Service Warranty. The Certainty Group will provide a full refund of the Total System Performance (TSP) service fee if TCG cannot diagnose the root causes of your Oracle database environment performance bottlenecks. TCG will grant such refund in a timely and expeditious manner following the written receipt of your refund request. Refunds are not granted after a 30-day period following acceptance of the final TSP reports. This service warranty and refund policy are limited to The Certainty Group Total System Performance consulting engagements. If you have procured other professional services from The Certainty Group under a separate agreement, such professional services are not applicable to this guarantee and refund policy. This guarantee is subject to the provisions of your contract with The Certainty Group. THE CERTAINTY GROUP DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SOME STATES DO NOT ALLOW AN EXCLUSION OR LIMITATION ON THE LENGTH OF AN IMPLIED WARRANTY, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

The Certainty Group reserves the right to modify its guarantee and warranties at any time at its sole discretion.
